AECU: AN ASSOCIATION OF CONSUMERS AND USERS?

            The newspapers of provincial issue Información and La Verdad (and gathered his news for Catral digital) echo is done in today of the celebration yesterday in the House of Catral's Culture, of an informative meeting summoned by the called one European Association of Consumers and Users of Urbanism (Asociación Europea de Consumidores y Usuarios de Urbanismo. AECU) which, apparently, they attended near three hundred persons  (according to  La Verdad) and four hundred persons (according to Información) and in that AECU  demonstrated his intention and obtained the support of the assistants to exercise jurisdictional actions against Catral's Town hall, if this one does not rectify in his intention of which the owners of the housings out of arrangement of the municipality, take charge on behalf of the cost of the infrastructures necessary for they to be able to grant licenses of work. And not for there. Also it tries to sue the Valencian Autonomous government and the promoters; to the Architects' professional Collegeand;  and finally, to appeal the Ombudsman to ask for his aid.

           The first thing that we would have to appear is if these lawsuits are viable. We are calmed by the ounique thing that we see sensible of everything what the correspondents inform: that Don Juan Jose Díez Sánchez is going to ask him for the opinion of the teacher of the University of Alicante. We wait anxious for his opinion.

           Every person is in his right to exercise actions before the Judges and Courts, against whom he estimates suitably. There everyone with the consequences of this exercise, which we understand fundamentally in a Constitutional state, since the labor ticket inspector of the Judicial Power is indispensable. Now then, with independence of it, it is necessary to unmask once and for all AECU. Catral digital can affirm that we are before one of the coarsest maskings that can be done in relation by the defense of the consumers, because it turns out that AECU, IS NOT A CONSUMERS’ ASSOCIATION.   

           AECU is not registered in any of the Records any of the Consumers' Associations and Users nor of Spain nor of any other European, indispensable requirement that demands the Law to be considered to be A Consumers' Association. It is, simply and simply, a cultural association that does not have juridical transcendency beyond that that of a friends' club. It cannot exercise the own rights of these associations that are recognized in the Legislative Royal Decree 1/2007, of November 16, by which there is approved the Remolten Text of the General Law for the Defense of the Consumers and Users.

           Therefore, it turns out that it seeks protection in the name to create confusion on the reality, we suppose that in order to remove any type of initial reticence that will be able to be had for by her.  On having called like (with premeditation, we deal) it calls,  It creates a confidence climate that avoids any other checking for those whom -supposedly- it tries to defend and not to be able, for not being legitimized for it.          

            But, why does not AECU register in the suitable Record? The Consumers' Associations register in Spain in the Record of the Ministry of Health and Social Politics if they are of national area; and in those of the Councils of Health of the autonomous governments if only they are of these territories. These organisms demand from them a series of tending requirements, fundamentally, to give the maximum transparency to the associations that register. This way, they must deposit the accounts anually, publicizing them, to realize from time to time and to communicate the result of the elections to his managerial charges, to elaborate and to approve an annual budget, etc., In exchange, beside being declared of public usefulness and have right to the free justice in the terms foreseen in the Law, they can request the subsidies that the public Administrations summon to contribute with his expenses. We are not given to inspect, but the doubt arises: will not it be that to AECU -or to his scanty leaders- him this transparency is not convenient?

           The certain thing is that this association, on not having been registered where it must be to be, exactly, an association defender of the consumers (since it is, for putting an example catralense, the Housewives' Association Lucentum), she behaves in a suspicious way and, at sight he is, masking his reality. In addition his aim is not understood well. We compare it to the fact of constituting a sports club and then not to register it in the corresponding federation to compete. Is mere exhibition claimed only in such cases?

           As for the fund of the treated in the meeting, let's expect to know the guessed right criterion of the teacher Díez Sanchez. And much we are afraid that the proposed pretensions will turn into water between  the hands. To Catral's Town hall it protects the Law in the decisions that he has adopted. They will be able or not to be shared, but, in the matter I object of the meeting, we have to say, using the juridical aphorism that detach bonus fomus iuris (smell of good Law).
